SACRAMENTO, Calif. California mental health attorney Ken Rosenfeld intervened on behalf of Joshua Lewis to halt any further proceedings against his client in favor of providing him with mental health treatment consistent with the California statute of Mental Health Diversion (PC1001.36).
According to the January 20, 2022, criminal complaint filed with the El Dorado County Superior Court, Lewis was alleged by El Dorado district attorney Vern R. Pearson to have committed two felonies with enhancements: Willful, Deliberate, and Premeditated Attempted Murder (PC664/187(a)) and Assault with a Deadly Weapon (PC245(a)(1)). Pursuant to PC664/187, deliberate premeditated murder amounts to first-degree attempted murder and, if convicted, carries a punishment of life in prison with parole; a felony conviction of PC245 assault with a deadly weapon carries the penalties of 2-4 years imprisonment with fines and felony probation. Rosenfeld successfully argued that the mental health issues suffered by Lewis significantly contributed to his committing of the alleged crimes and that Lewis met all the requirements to qualify for Mental Health Diversion as per the conditions of California PC1001.36. Lewis was released on his own recognizance and is currently receiving treatment in a residential facility.
Rosenfeld said he was pleased his client will get the kind of mental health assistance he needs.
